This article aims at taking the discussion to a fundamental and methodological dimension that ensures the genuinity and soundness of the maqasid approach, and introduces the basic fundamentals of a new “Maqasid Methodology”. The formative and hegemonic principle here is the Quran and the Sunnah of the Prophet (sas). Three fundamental logical premises are introduced, namely, connectivity, wholism and emergence. Then, a justification of the necessity of using the “Maqasid Methodology” is presented, namely, future, critical and comprehensive orientations. Under this label, writers engage in distortion, obfuscation, and unwarranted projections without fear of academic scrutiny or rigorous investigation, as the subject is shielded by the notion of the “imaginary”. The study seeks to survey as many critical studies of <em>Ḥadīth</em> sciences and <em>Sīrah</em> (Prophetic biography) as it can access, examining the methodological tools employed by these scholars. It adopts a critical-analytical approach to presenting their ideas, highlighting their methodological errors and unjustified interpretations in engaging with the Sunnah and<em> Sīrah</em>. The research endeavors to analyze available academic papers, published books, written articles, and recorded discussions, considering their widespread impact across diverse audiences—from specialists to intellectuals and the general public. Second: The loss of justice in social relations, whether in understanding or commitment, is one of the big problems that prevent the improvement and development of nations. The research aims at two objectives: First, to explore the prophetic methods for determining the Maqasidiat of justice in the Prophetic Sunnah; Second: to explore the prophetic mechanisms in activating (<em>maqsid</em>) the preservation of social justice; This will allow us to understand the importance of social justice and its place in the Maqasid of the Sharia and the interest of the Prophet, and will help us in the overall theoretical construction of the Maqsid of social justice and other Maqasid, and will provide us with the ideal methodology for the proper management of relations between the different components of society and the preservation of rights and freedoms. We combine good activation and good action in our lived reality and our expected future. We have presented many hadiths with diverse meanings, fields, and multiple rulings to achieve these objectives. We have studied, classified, and analyzed them, and explained their common theme and their relationship to preserve social justice in thought and reality. This divergence necessitated an exploration of the boundaries and relationships between the two concepts in their universal and partial aspects. This investigation required prioritizing the universal over the particular in all cases to ensure the preservation of religion's human objectives and the self's existence and purpose of creation. The study examined the conflict between religion and the self when they overlap by presenting examples from the objectives-oriented tradition and offering opinions on them. Consequently, the research sought to outline principles and methodological requirements in an objectives-oriented framework, demonstrating that both religion and the self are preserved in their universals. Even if certain particulars of religion are deferred in favor of the universality of the self, this is done to ensure their mutual preservation. This paper explores the concept through divine revelation, highlighting its essence, dimensions, and functions. It identifies <em>Tazkiyah</em> as a governing principle aimed at purifying and elevating individuals and communities, preparing humanity for civilizational development and stewardship. Despite their differences, two main developments can be identified: First, the shift towards rationalizing Sharia and excluding or even eliminating its devotional aspect; and second, the redefinition of the maqasid, expanding their number and interpretations. Through presenting different models of new interpretations of the maqasid, the researcher demonstrates how modernity has influenced this new maqasid discourse, not by adopting modern concepts, but by acquiring the fluid nature of modernity itself. The most significant transformation was the shift of maqasid into a flexible and malleable tool, capable of being used to either approach or distance from modern values. With this fluidity, maqasid often reflected the jurist’s ideological, social, and psychological biases, whether consciously or unconsciously.
