Therefore, Islam exerts great emphasis on the family and considers it one of the most important issues that the Qur’an accompanies with several concepts, values, and worldviews. The examiner of the Qur’anic view must note that the Qur’an deals with the subject of the family within an objective-oriented framework based on establishing the umran. Therefore, it can be said that the purpose of establishing the family and giving it a moral framework has an umranic objective in the light of the Qur’an and its guidance. This article emphasises the importance of the family in Islam as a means and the essence of umran and it highlights the role of the Qur’anic values of virtue and grace in regulating the family and establishing umran. This article also decentralizes the contractual aspect such as in the value of ‘adl (justice) and centralizes the aspect of tarahum (compassion) such as the value of virtue, grace, and bounteousness as founding constituents for the family and umran to protect people from committing injustices and ensuring the continuity and stability of the familial and human umran at large.
Farid Chokri Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 1 18 10.52100/jcms.v3i2.143 مقاصد الأسرة في الزمن الرقمي https://journal.maqasid.org/index.php/jcms/article/view/144
The Islamic Shari’ah has always accentuated the importance of family throughout an abundance of solid, precise, and purposeful legal texts. Indeed, most Qur’anic rulings revolve around the family as the nucleus that preserves the social and human order. Yet, in the modern era, the emergence of the Internet has contributed to accelerating the process of social transformation, to the point that we are no longer facing simple changes. Still, rather we are facing sudden bursts of alterations on various levels, which affect the nature of social relations in terms of their establishment, enactment, and continuation. Our aim in this paper is to look at the transformations that have affected the maqasid system in modern times, by focusing on the age of digitisation and its impact on human society, and the family in particular. This paper also attempts to focus on the influence of new media on the family relationship system by discussing the transformations in the system of Islamic objectives and values and their critical effects on family cohesion.
Jamila Tilout Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 19 46 10.52100/jcms.v3i2.144 منظومة القيم المقاصدية وأثرها في الاستقرار الزوجي https://journal.maqasid.org/index.php/jcms/article/view/145
This research investigates the issue of marital stability through a maqasid approach that emphasises the maqasid theory and its essence based on values. Thus, talking about the purposes of the marital relationship should not take place in isolation from the system of values that regulate the orientations and behaviours of spouses in a way that ensures the stability of the relationship. This paper deals with the maqasid of marital relationships and the way to activate maqasid shari’ah within the Islamic values system to realize marital and familial stability. Therefore, the Maqasidi scholar must start from the system of Islamic values presented in the legal discourse to build a maqasid-based ethical theory that focuses on achieving the interests of the family and the marital relationship, preventing harm and corruption, keeping pace with the changes that occur in the structure of family and marital relationships, and confronting all challenges and dangers that compromise familial and marital existence.
The Muslim family in Islamic and non-Muslim societies faces different challenges that hinder its existence, function, and future. At the top of these challenges is the lack of maqasid-based comprehension of the family and its relation to all aspects of life and the impact it had on the function, role, relationships, transactions, and even on its position in these societies and their future. The legal situation, contemporary family education, and the climates of upbringing in Arab and non-Arab societies and the personalities it produces with differing attitudes, inclinations, values, and aspirations lack the clarity of the essence of the family’s purposes and the relationship of these purposes to their lives. This article clarifies these maqasid and their relationship to the educational social, and psychological aspects of the family and it also illustrates the roles and functions of the family in educational and social sciences and their relationship to the Islamic purposes of the Muslim family and its future and activation.
Majdy Helal Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 91 116 10.52100/jcms.v3i2.146 هوية المصطلح المقاصدي https://journal.maqasid.org/index.php/jcms/article/view/124
This research paper deals with a topic that is characterized by innovation and difficulty at the same time. It explores the definition and roots of maqasid terminology, the basis of its implementation, and the methods for tracing its formulation and origins among scholars. The paper also delves into the dimensions of maqasid terminology and its various impacts. This article blends the descriptive, inductive, and analytical approaches. The paper deduces that maqasid terminology has some distinguished features and characteristics and that its implementation and conceptual demystification are critical. This is due to its salient traits and the repercussions that come with it at the level of Shari’ah rulings that extend to religious practices and worship. Therefore, if the maqasid terminology is not well-regulated, it will be detrimental to the Islamic Shari’ah and its purposes.
الميلودي خطاب Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 117 138 10.52100/jcms.v3i2.124 Islam, Welfare Social Services and Human Dignity https://journal.maqasid.org/index.php/jcms/article/view/142
Over the last few decades, Muslim humanitarian NGOs and grassroots social work organizations have emerged worldwide, in both Muslim-majority and non-Muslim-majority societies. Unlike the 'traditional' welfare mechanisms provided by ancient Muslim institutions, these new organizations took the form of secular welfare NGOs and civil society associations, adding an 'Islamic' label to highlight their specific identity. They claim to act according to Islamic guidelines, their Muslim identity, or their faith. Although many of these Muslim organizations offer valuable and useful social services and humanitarian aid to those in need, it is common to observe practices within these organizations that contradict Islamic teachings. Based on the observation that numerous Muslim organizations inadvertently deviate from basic Islamic principles in their projects and policies, this article aims to initiate a discussion on the ways to align social work and humanitarian aid with Islamic principles. It will present examples of so-called 'Islamic-based' social services, drawn from previous sociological studies, to highlight the current situation before attempting to identify normative guidelines based on a Maqasid approach to the Islamic scriptures.
Baptiste Brodard Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 139 154 10.52100/jcms.v3i2.142 Between Nationalism and Universalism https://journal.maqasid.org/index.php/jcms/article/view/126
Countries strive to highlight their national identities and cultural heritage, particularly in Sports Mega Event (SME). This study sheds light on Qatar 2022 World Cup experience, in which Qatar highlighted the Qatari national identity and its Gulf/Arab/Islamic elements, by studying the media propaganda against the Qatar 2022 bid and questioning its content alongside revealing the extent to which it was credible, particularly because the Qatari identity was a prominent factor in the championship. The study covers a timeframe from December 2010, when Qatar received the right to host the World Cup, through the years of preparation and planning, to the organization stage, which began on November 20th and continued until December 2022. Through descriptive and analytical study, the study seeks to highlight the Qatari experience in preserving its Arab and Islamic identity, achieving sustainability, and managing World Cup security in a way that is complied with the goals of Islamic Sharia. It also compares various international experiences in the field to accurately evaluate the Qatari experience. The findings of the study reveal Qatar succeeded in promoting the Qatari Islamic and national identity via banning liquors and homosexualism and fulfilled its overlapping economic and social goals reflected in the growth of Qatari economy and the growing perception of Qatar as a safe and attractive venue worthy of visits and investment. These findings are in line with Maqasid Shariah and present recommendations to organizing bodies globally on how to achieve positive aspects in SME and leverage in similar experiences.
Salwa Hamed Almulla Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 155 180 10.52100/jcms.v3i2.126 Virtue And The Common Good https://journal.maqasid.org/index.php/jcms/article/view/152
Nekroumi, Mohammed, Virtue And The Common Good: Hermeneutic Foundations of Aš-Šāṭibī's Ethical Philosophy. This article contributes to redressing this lacuna by applying the method of content analysis to the Qur’an, specifically, the terms ‘ahd and mithaq that refer to the concept of covenant. The aim of this article is to identify the maqasid (higher objectives) of covenants in Islam and discuss their implications for education about Islam and contemporary Islamic thought. This content analysis finds that covenants in the Qur’an provide an overarching paradigm governing human existence and coexistence across six covenantal relationship categories. Covenants establish the terms and conditions of God-human and intra-human relations for human existence on Earth in relation to the afterlife, the dissemination of the divine message, the promotion of righteousness, welfare and wellbeing, and restricting the use of armed force to self-defence in response to treaty violation for preserving peace and security. This article recommends that the study of Qur’anic covenantal knowledge ought to be integrated into courses and discourses about Islam commensurate, with its centrality in the Qur’an and Prophet Muhammad’s approach to building peaceful interreligious relations between Muslims and non-Muslims.
Halim Rane Mawloud Mohadi Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-29 2024-07-29 3 2 185 228 10.52100/jcms.v3i2.147 حوار مع الأستاذ الدكتور عبد الله الجديع https://journal.maqasid.org/index.php/jcms/article/view/149
Mawloud Mohadi Copyright (c) 2024 Journal of Contemporary Maqasid Studies https://creativecommons.org/licenses/by-nc/4.0 2024-07-30 2024-07-30 3 2 229 246 10.52100/jcms.v3i2.149
