Abstract

This paper deals with one of the most important issues related to modern Moroccan reformist thought, namely the presence of maqasid in Islamic jurisprudence. This Maqasidi thought is of paramount importance in understanding the emerging cases and issues that occurred as a result of the encounter between the colonial project and the Muslim world. This paper attempts to highlight that the awareness of maqasid is a prerequisite in developing the country socially, politically, economically, and scientifically. This represents a starting point for the realization of the purposes of civilizational progress and inhabiting earth which in return achieve the objective of vicegerency and Muslim empowerment. Moroccan intellectuals led by the great maqasidi and the post-modern Salafist thinker, Allal El-Fassi, had called for the reconsideration and reactivation of ijtihad in Islamic jurisprudence based on the purposes of legislation to advance the ummah and highlight the purposes of reform and renewal in various areas. the paper follows the descriptive, historical and inductive methods which serve as tools in producing a resformist maqasid-based framework.
